Mr. Newton
is a partner and has practiced with the firm since
completing law school. His practice focuses on the
defense of doctors, nurses and hospitals in medical
malpractice cases in North Carolina. A significant
portion of his practice has been devoted to the
defense of healthcare providers in catastrophic injury
cases, and he has developed a special interest in
defending the damages portion of catastrophic injury
cases. In the non-medical setting, Mr. Newton has been
involved in the defense of products liability cases
and in a select number of cases on behalf of
plaintiffs. He has
significant experience with trying multi-week civil
jury trials in state superior court and with
conducting focus group exercises.
In 2009, Mr. Newton
was selected as a Fellow in the Litigation Counsel
of America™.
The Litigation Counsel of America (“LCA”)
is an invitation-only national trial lawyer honor society.1
Membership is limited to 3,500 Fellows, representing
less than one-half of one percent of American
lawyers. The purpose of the LCA is to
recognize deserving, experienced and highly
qualified lawyers, to promote scholarship, and high
ethical standards, and to advance a superior
judiciary. Fellows are selected and invited
into Fellowship after being evaluated on
effectiveness and accomplishment in litigation and
trial work, along with ethical reputation.
In 2010 and 2009, Mr. Newton was also
selected for inclusion in North Carolina's
Super Lawyers--Rising Stars Edition (a category
for attorneys 40 years old and younger), selected
by peer evaluation in practice area. No more than
2.5% of North Carolina's attorneys are named to
the Rising Stars list.2
In 2010, 2009 and 2007, Mr. Newton was voted as
one of North Carolina's "Legal Elite" in the
"Young Guns" category (of North Carolina's
best attorneys under 40 years old), in a survey
done by North Carolina Business Magazine.
Selection for this distinction is based upon
ballots sent to every lawyer licensed by the State
Bar living in North Carolina.3
In 2008, Mr. Newton was elected to serve as the
statewide Treasurer of the North Carolina Chapter of
the Association for Hospital Risk Managers. The
North Carolina Chapter was established in 1980, has
over 200 active members, and focuses on advancing
the development and professional practice of
healthcare risk management through education and
training.
Mr. Newton attended his first year of law school
at Mercer University in Macon, Georgia. At Mercer, he
placed in the top eight percent of his class, received
an offer of an academic scholarship, received the
Faculty Award for Achievement in Legal Writing and was
invited to join the school's law review journal based
upon his academic performance. After deciding he
wished to return home to North Carolina to practice
law, Mr. Newton transferred to and graduated from Wake
Forest University's School of Law, where he graduated
in the top-third of his class and received top
academic awards in Complex Civil Litigation, Dispute
Resolution and Remedies courses.
At Wake Forest, Mr. Newton was selected as a
member of the school's National Moot Court Team, which
advanced to compete in the final rounds of the
American College of Trial Lawyers' National Moot Court
Competition in 1998-1999. He was selected for
membership in the school's Chief Justice Joseph Branch
Inn of Court, was awarded membership in the Order of
Barristers, and received the school's Moot Court Board
Award for Outstanding Contribution upon graduation.
Mr. Newton placed as a semi-finalist in the school's
26th Annual Stanley Moot Court Competition and was
also selected to serve as member of the school's
Constitutional Law Moot Court Team for the Craven
competition held in Chapel Hill, North Carolina.
Mr. Newton has served as a member of multiple
committees of the North Carolina Bar Association
including the Technology Advisory Committee
(2000-2004), the Medico-Legal Liaison Committee
(2004-present) and the Litigation Section's Technology
Committee (2006-2007). He
also served as a member of the Conference Program
Committee for the North Carolina Association of
Hospital Risk Managers (2007-2008). He has
given lectures on medical malpractice, legal
malpractice, professionalism and civil
discovery to attorneys and paralegals and has
frequently lectured to physicians, nurses, and
hospital staff on current issues and trends in medical
malpractice in North Carolina.
In his spare
time, Mr. Newton enjoys running, Asian cooking, and
international travel. Closer to home, he enjoys
spending time with his family in eastern North
Carolina.
