Super Lawyers Honors 10 Yates, McLamb & Weyher Attorneys

is Top Point Recipient, No. 1 Super Lawyer in State

—Yates,
McLamb & Weyher (YMW) today announced 10 of its attorneys have
been recognized by North Carolina Super Lawyers magazine,
five as Super Lawyers and five as Rising Stars.
Founding partners Dan McLamb and Barbara “Bonnie” Weyher
received additional accolades; McLamb is included in the Top 10
NC Super Lawyers list and received the most points of any
attorney in the state, and Weyher, the current NC State Bar
president, is included in the Top 50 Women NC Super Lawyers.
The selection process for Super Lawyers,
which is published
by Law & Politics and Key Professional Media, Inc., includes a
statewide survey of lawyers, an independent evaluation of
candidates, as well as a peer evaluation. For Rising Stars,
lawyers are asked to nominate the best attorneys who are 40
years of age or under, or who have been practicing for 10 years
or less. They are instructed to nominate lawyers they have
personally observed in action, whether as opposing counsel or
co-counsel, or through other firsthand courtroom observation.
Only five percent of the attorneys in each state are recognized
by Super Lawyers.

DAn McLamb Receives
Lawyer of the Year Award
RALEIGH, N.C. (December 8, 2009) —
Best Lawyers recently named Dan J. McLamb, founding
partner of Yates, McLamb & Weyher, L.L.P. (YMW), as the
Raleigh Best Lawyers Personal Injury Litigator of the Year
for 2010. McLamb’s practice at YMW is focused on the defense

Provides Insight at
NCBA Insurance Law Update
RALEIGH, N.C. (November 11, 2009) —
Raleigh attorney Jennifer (“Jennie”) D. Maldonado, a partner at
Yates, McLamb & Weyher, L.L.P. (YMW), spoke at the North
Carolina Bar Association’s Insurance Law Update on November 6.
The Law Update program was designed to inform and excite counsel
for individual and commercial policyholders and counsel on the
insurance company side about the many practice areas of
insurance coverage, bad faith and regulatory compliance.
Maldonado’s presentation, titled “Hot
Topics in Professional Liability Errors and Omissions Insurance
Coverage,” addressed common insuring agreements, standards for
reporting claims, examples of covered claims and exclusions, and
some of the most recent cases and trends.
Maldonado received her law degree from
Campbell University in 1998 and her practice at YMW focuses on
the defense of personal injury and commercial matters,
construction and coverage litigation. In addition to this
presentation, Maldonado has taught seminars in litigation case
management, medical records translation, settlement strategy,
success at mediation and accident investigation. She currently
serves as a member of the Minorities in the Profession Committee
and State Bar Diversity Task Force.
Weyher Sworn-In as President of the
North Carolina State Bar

& Weyher partner is second female NC State Bar president
RALEIGH, N.C.
(October 22, 2009) —
Barbara (Bonnie) Weyher
took the oath
of office last night as the new President of the North Carolina
State Bar, becoming only the second woman to hold the position.
She was sworn in by the Honorable Sarah Parker, Chief Justice of
the North Carolina Supreme Court, during a ceremony in downtown
Raleigh. She succeeds John B. McMillan of Raleigh.
Ms. Weyher is a founding partner
of Yates, McLamb & Weyher, L.L.P., a civil defense law firm
based in Raleigh. She brings to the Bar’s presidency a long
history of serving on its governing Council and as an officer.
Before her election to the Council, Ms. Weyher
chaired the Grievance Committee, Ethics Committee, and the
Authorized Practice of Law Committee and has served on the
Executive Committee, Issues Committee and Publications
Committee.
The Bar is the
state agency that regulates more than 20,000 lawyers who are
licensed to practice in North Carolina. One of the Bar’s key
responsibilities is the investigation and prosecution of lawyers
who violate its code of ethics for lawyers. Additionally,
Ms. Weyher has been active in the North Carolina Bar
Association, chairing the Litigation Section (2005-06). She
served as President of the Wake County Bar Association in 1997.
“I have been
privileged over the years to be involved with the North Carolina
State Bar and have a great respect for the organization and its
members,” said Weyher. “In the coming year, we will be exploring
ways to increase the number of women and minority lawyers on the
State Bar Council. A number of mandatory bars in the country
have taken proactive measures to encourage more minority and
women lawyers to participate and we will first be looking at
these programs to see what has worked and what has not.”
Ms. Weyher is
a 1973 graduate of the University of North Carolina at Chapel
Hill, where she earned a bachelor’s degree in journalism. She
graduated in 1977 from the UNC School of Law and served as a
staff member of the North Carolina Law Review.
Ms. Weyher
practiced law in New York City before returning to North
Carolina in 1979 to join the Raleigh firm of Young, Moore,
Henderson & Alvis. In 1983, she became a founding partner of
Yates, McLamb & Weyher, where she has since practiced along with
her husband and law partner Dan McLamb.

Present at NC Association of Long Term Care Facilities
Convention and Trade Show
Yates, McLamb &
Weyher, L.L.P. (YMW) attorneys Barry S. Cobb and Maria Papoulias
Wood recently spoke at the 2009 North Carolina Association of
Long Term Care Facilities (NCALTCF) Convention and Trade Show in
Winston-Salem.
The theme of the NCALTCF event, held September 20-24, was
“Recovering from Depression: The Future is in Our Hands” and
focused on transforming adult care homes to reflect the
innovation and recovery occurring in the current state of
financial crisis. Cobb and Wood led a two-hour continuing
education course titled “Transforming ACH: Disaster-Preparedness
Against Litigation.”
Cobb, a partner at YMW, attended UNC-Chapel Hill as an
undergraduate and graduated with honors from UNC Law School. His
practice at YMW focuses on the representation of physicians,
hospitals and long-term care facilities in medical malpractice
matters. He provides risk management consulting services for
hospital clients and represents physicians, dentists, and
pharmacists before their respective North Carolina licensing
boards. In addition to the NCALTCF presentation, Cobb has taught
seminars in nursing home negligence, risk management for
hospitals and long-term care facilities, advanced negotiation
and advocacy in mediation, legal issues for nurse practitioners,
and effective legal writing. Cobb is a certified mediator.
Wood completed undergraduate studies at UNC-Chapel Hill before
attending Wake Forest University School of Law. Wood then joined
Wilson & Coffey, L.L.P. in Winston-Salem in September 2001 where
she practiced in the areas of professional malpractice,
including medical malpractice defense and legal liability, and
insurance defense. Wood joined YMW in March 2006 and focuses on
medical malpractice defense and long-term care liability
defense. Wood’s representation of long-term care facilities
includes both skilled nursing and assisted living facilities
throughout the state. Her representation of physicians and
long-term care facilities includes not only litigation but also
matters before state licensing boards.

ANNUAL MEETING
Barbara
(Bonnie) Weyher, a founding partner of Yates, McLamb & Weyher,
LLP, was a guest speaker at the North Carolina Society of
Healthcare Attorneys annual meeting on October 16 in Chapel
Hill. The topic was Conflicts in Healthcare Representation. The
North Carolina Society of Healthcare Attorneys is a nonprofit
corporation offering professional education to North Carolina
lawyers interested in healthcare law. Each year, the Society
meets to discuss current and future healthcare issues and legal
trends.
Business Leader Magazine Selects
Dan McLamb as 2009 Triangle Mover and Shaker

RALEIGH, N.C. — Dan McLamb, founding partner of Yates, McLamb
& Weyher, L.L.P. (YMW), has been recognized by Business Leader
magazine as a 2009 Triangle Mover and Shaker.
The award, which honors business leaders in the Triangle
community, is given to rising leaders within companies with
more than 100 employees or C-level executives/partners leading
rising companies with fewer than 100 employees.
Dan was selected based on his 26 years of skillful leadership
at YMW. Since its opening, he has helped lead the firm’s
growth and development, taking it from just nine employees to
60. Additionally, he has worked diligently to uphold the
firm’s mission to provide creative, skillful, attentive and
zealous defense to clients while upholding the highest
standards of ethics and service to the profession and
community. Dan also spends a great deal of time mentoring and
working closely with young associates, helping them build
strong practice skills and instilling the professionalism on

JANICEK JOINS YATES, MCLAMB & WEYHER L.L.P.
Yates, McLamb &
Weyher, LLP, today announced that Kristen R. Janicek has joined
the firm in the area of medical malpractice litigation.
Ms. Janicek brings
extensive knowledge of healthcare in North
Carolina, having served as a registered nurse in the surgical
intensive care unit at the University of North Carolina at
Chapel Hill medical center. With the addition of Ms. Janicek,
who clerked with the firm last year, YMW’s medical
malpractice group now employs a
physician attorney and three registered nurse attorneys.

Meyerhoffer of YMW’s medical malpractice group. “The combination

DEBBY SAWYER ELECTED
TO NATIONAL OFFICE
Debby Sawyer, CP, paralegal
with the Raleigh law firm of Yates McLamb & Weyher, has been
elected Region 11 Director of NALA, The National Association
of Legal Assistants/Paralegals. She was elected during the
Association's 34th Annual Meeting on July 10 in San Diego, CA,
and will serve on the NALA Board of Directors for 2009-2010,
representing Maryland, Washington, DC, West Virginia,
Virginia, North Carolina, and South Carolina.
A paralegal since 1992, Ms.
Sawyer became a Certified Paralegal (CP) in 2004 and has
served in a number of leadership positions for both the North
Carolina and Tidewater Paralegal Associations. She was a
presenter in the NALA Affiliate Exchange program in 2007 and
received the NALA Affiliated Associations Award and the
Tidewater Paralegal Association Founders Award in that year.
She also served in NALA's Affiliated Association Secretary for
2007-09.
She has a BS in Leadership
and Management from Regent University, Virginia Beach, VA, and
earned her paralegal certificate from Jackson State Community

SELECTED AS FELLOW OF LITIGATION COUNSEL OF AMERICA
RALEIGH, N.C. (July 7,
2009) — Raleigh attorney Jason D.
Newton, a partner at Yates, McLamb & Weyher, L.L.P., has been
selected as a
Fellow in the
Litigation Counsel of America™ (LCA),
an invitation-only trial lawyer
honor society. Newton is a litigator in the firm's medical
malpractice defense litigation practice area.
The LCA
limits its
membership to 3,500 Fellows, representing less than one-half of
one percent of American lawyers. The purpose of the LCA is to
recognize deserving, experienced and highly qualified lawyers,
promote scholarship and high ethical standards, and advance a
superior judiciary. Fellows are selected after being evaluated
on effectiveness and accomplishment in litigation and trial
work, along with ethical reputation.
A 1994 graduate of
the University of North Carolina at Chapel Hill, Newton received
his juris doctor degree from Wake Forest University in 1999 and
has practiced with Yates, McLamb & Weyher, L.L.P. since
completing law school. His practice focuses on the defense of
doctors, nurses and hospitals in medical malpractice cases in
North Carolina. A significant portion of his work is devoted to
the defense of healthcare providers in catastrophic injury cases
and resulting damages.
In the non-medical
setting, Newton has been involved in the defense of products
liability cases and in a select number of cases on behalf of
plaintiffs. He has significant experience with trying multi-week
civil jury trials in state superior court and with conducting
focus group exercises.
Newton’s previous
accolades include being named a 2009 North Carolina Super Lawyer
Rising Star and one of North Carolina's Legal Elite in the Young
Guns category (2007 and 2009). Newton currently serves as the
Treasurer of the North Carolina Chapter of the Association for
Hospital Risk Managers.
Newton has served as
a member of multiple committees of the North Carolina Bar
Association including the Technology Advisory Committee
(2000-2004), the Medico-Legal Liaison Committee (2004-present)
and the Litigation Section's Technology Committee (2006-2007).
He is a former member of the Conference Program Committee for

LORI A. MEYERHOFFER
APPOINTED TO NC BAR MEDICO-LEGAL LIAISON COMMITTEE
Lori A. Meyerhoffer,
M.D., an attorney at Yates, McLamb & Weyher, L.L.P., was
recently appointed to the North Carolina Bar Association’s
Medico-Legal Liaison Committee for the 2009-2010 fiscal year.
The Medico-Legal Liaison Committee is responsible for periodic
review of and revisions to the Medico-Legal guidelines and for
promoting the understanding and cooperation between the bar and
the medical profession.
Dr. Meyerhoffer
graduated with high honors from the University of
South Florida
College of Medicine and, after practicing medicine for 13 years,
returned to school and earned her degree in law from the University
of North Carolina at Chapel Hill in 2007. After her admission
to the bar, she joined Yates, McLamb & Weyher, and still
continues to practice medicine on a limited basis. In addition
to serving on the Medico-Legal Liaison Committee, Meyerhoffer is
currently a member of the American Health Lawyers Association,
American Bar Association and the North Carolina Bar Association.

HEATHER R. WILSON ELECTED TO NCADA BOARD OF DIRECTORS
The North
Carolina Association of Defense Attorneys (NCADA) held its 32nd
Annual Meeting at the Hilton Head Marriott Resort & Spa, Hilton
Head Island, South Carolina during the weekend of June 18-21,
2009. Officers and board of directors for the 2009-2010 year
took office at the close of the Annual Meeting on June 21, 2009.
Heather R. Wilson was elected to serve a three-year term on the
Board of Directors and serve as the chair for the Medical
Malpractice Practice Group. Her litigation practice includes
medical malpractice defense, nursing home litigation,
pharmaceutical litigation, administration/board actions and
insurance coverage. Ms. Wilson is a 2001 graduate of Campbell
University School of Law.

Honored with Local Alumni Award
Attorney Barry Cobb to Receive First Warrior Cup Award from
Lawrence Academy
RALEIGH, N.C.

Barry S. Cobb, a partner at Yates, McLamb & Weyher, L.L.P., will
be honored at Lawrence Academy’s upcoming commencement ceremony
as the school’s first recipient of the Warrior Cup, an award
recognizing distinguished alumni. He will also address the Class
of 2009.
The Academy,
located in Merry Hill, N.C., noted the award is given to the
alumnus who best demonstrates extraordinary service to his/her
community, distinction in one’s field of specialization, and
service to society. Additionally, the Warrior Cup award
celebrates the alumni’s educational experience at Lawrence
Academy and aims to encourage students to set goals for their
futures and envision the contributions they can make to society.
Cobb was born
in Greenville, N.C., and attended the University of North
Carolina at Chapel Hill with a Morehead Scholarship and later
graduated with Honors from the UNC School of Law. At Yates,
McLamb & Weyher, he focuses his practice on the representation
of physicians, hospitals and nursing homes in medical
malpractice matters. Cobb teaches seminars in nursing home
negligence, advanced negotiation and advocacy in mediation,
legal issues for nurse practitioners, and effective legal
writing.

“I’ve been away from Merry Hill for a long time now, but my
roots are deep there. I’ll always be grateful for the education

listed as one of the 27 defense lawyers in the medical
malpractice section of the North Carolina Super Lawyers 2008
magazine.

John Newby, Jr., Claire Hunter and Elese Epps join Triangle
civil defense litigation firm

announces John P. Newby, Jr., Claire A. Hunter and Elese C. Epps
as summer associates who will be working with a number of the
firm's attorneys to maximize their exposure to a variety of
practice areas.

are elated to welcome Mr. Newby, Ms. Hunter and Ms. Epps to our
summer clerk program,” said Dan McLamb,

Mr.
Newby is a juris doctor candidate at the University of North
Carolina School of Law for the class of 2010. He interned last
summer for the Honorable Robert Hunter at the N.C. Court of
Appeals and the Honorable Paul Newby at the N.C. Supreme Court.
Mr. Newby received a Bachelor of Arts degree in history and
political science, cum laude,
from Furman University, where he also lettered in varsity
football.
Ms.
Hunter is a juris doctor candidate at the University of North
Carolina School of Law for the class of 2010. She has interned
at the Biotechnology Industry Organization in Washington, D.C.
and with the Governor’s Office of Boards and Commissions with
North Carolina State University. Ms. Hunter received a Bachelor
of Arts degree in journalism, mass communication and political
science from the University of North Carolina at Chapel Hill.
Ms.
Epps is a juris doctor candidate at the Wake Forest University
School of Law for the class of 2010. Last summer, she interned
with the Mecklenburg County public defender. Ms. Hunter received
a Bachelor of Arts degree in political science, cum laude,
from Wake Forest University.

MEYERHOFFER GUEST SPEAKER AT WAKEMED INTERNAL MEDICINE GRAND
ROUNDS
Lori Abel
Meyerhoffer was a guest speaker at WakeMed Internal Medicine
Grand Rounds on February 3, 2009, in Raleigh, North Carolina.
The lecture was well received by approximately 150 internal
medicine and internal medical subspecialty physicians. The
topic was “Malpractice Prevention 101.” The lecture included
discussion on how to decrease the risk of being sued for
malpractice, helpful suggestions for early dismissal if a
physician becomes a named defendant, and optimizing the chances
for a defense verdict if a physician is a named defendant. In
addition, common pitfalls of defending malpractice litigation
were discussed. An interactive question and answer period
followed the lecture.

MANAGERS
Jason
Newton, a partner with Yates, McLamb and Weyher, LLP, law
firm in Raleigh, was elected as the statewide Treasurer of the
North Carolina Chapter of the American Society of Healthcare
Risk Managers at the organization's Fall Conference in Asheville
on November 13, 2008. The North Carolina Chapter was
established in 1980, has over 200 active members, and focuses on
advancing the development and professional practice of
healthcare risk management through education and training.

SWORN IN AS PRESIDENT –ELECT OF THE NORTH CAROLINA STATE BAR
At the October 22, 2008 Annual Meeting of
the North Carolina State Bar, Partner Barbara (Bonnie) Weyher
was sworn in as President-Elect of the North Carolina State Bar
by the Honorable Sarah Parker, Chief Justice of the North
Carolina Supreme Court. Ms. Weyher will serve as
President–Elect until October 2009 when she will be installed as
President of the State Bar, becoming only the second woman to
hold that position. The North Carolina State Bar is the state
agency which regulates the practice of law in North Carolina.

participated as a panelist at the Annual Meeting of the North
Carolina Association of Women Attorneys in Asheville, North

AND CHRIS WEST PRESENT AT THE NATIONAL BUSINESS INSTITUTE IN
RALEIGH
Ryan Shuirman and Chris West both presented at the National
Business Institute's "Successful Medical Malpractice Suits"
seminar held in Raleigh on December 20, 2007. Their
presentations included discussions of potential conflicts in
representing malpractice defendants, the initial client
meeting and case strategy development, North Carolina's new
voluntary arbitration statute, trial preparation and strategy,
and general trial procedure. The seminar was attended by
practicing defense and plaintiff attorneys and insurance
representatives involved in medical malpractice litigation.

INSTALLED AS VICE PRESIDENT OF NC STATE BAR
Partner Barbara (Bonnie) Weyher was installed as Vice President
of the North Carolina State Bar at its Annual Meeting on October
18th, 2007. Ms. Weyher, who served for nine years as a Councilor
on the State Bar, was given the oath of office by Justice Mark
Martin of the North Carolina Supreme Court. She is only the
second woman to be elected as Vice President and will be in a
position to become President of the State Bar in October 2009.
Ms. Weyher is a prior Chair of the Litigation Section for the
North Carolina Bar Association and former President of the Wake
County Bar Association.

MALPRACTICE
Barbara ("Bonnie") Weyher and Heather Wilson of Yates,
McLamb & Weyher were speakers at the North Carolina Association
of Defense Attorneys Medical Malpractice seminar held in Winston-Salem, NC on Friday, April 27, 2007. Their presentation
addressed the ethical issues and potential conflicts which can
arise when defense attorneys represent more than one health care
provider in a single medical malpractice lawsuit. The
presentation included an interactive discussion of conflicts
which have arisen in actual cases and the appropriate resolution
of such situations.

Chambers USA 2007,
published by Chambers & Partners, a leader in legal guides
worldwide, has named partner Dan McLamb of Yates, McLamb &
Weyher, L.L.P., as one of the top three ("Band One") health care
litigators in North Carolina. The publication noted that Mr.
McLamb defends professional liability and catastrophic injury
cases for statewide clientele and that his peers report him to
be "tenacious, prepared and enduring." Chambers rankings result

Partner Barry Cobb
has been elected to serve a three-year term on the Litigation
Council of the North Carolina State Bar. Mr. Cobb has
served for the last two years as Co-Chair of the Ethics Committee of

Erin Young, who is in her first
year of a three-year term on the Council and also serves as
Co-Chair of the Public Service Committee.
